Draft pick from the Jets for tampering?

Do the 49ers have a possibilty of getting compensation from the new york jets for tampering In the Michael Crabtree case?

Has that been determined already or will it be decided in the near future?

Does any one have an educated guess as to what they think are the likely outcomes of all this?

Is it possible we could get a 2nd or 1st round pick?

(Anyway we have two first round picks next year and that is a good start. )

I don’t buy it, though. PFT loves to throw around rumors and unsubstantiated gossip when it comes to stories like this.
Jed York has said explicitly that there is evidence of tampering—though it’s not clear what that will mean in this case in terms of compensation.

Let me ask you this

When the Bears received compensation for the 49ers tampering, were they awarded a first or second round selection?

The Answer: No. If you recall, we swapped 3rd round choices with the Bears and were stripped of our 5th round selection (no one received it).

Regardless, the case is still pending and the league is investigating so none of use know the outcome.

I think the Jets would get penalized more because they tampered with a draft pick which could undermine the entire draft but as for compensation I doubt it is a 1st or 2nd.

we tampered with a franchise player

so by your logic we should’ve had to forfeit more than a 5th and swapping 3rds. Because, after all, signing a franchise player means the team you sign that player from gets not 1, but two first round draft picks.

the fact that Crab is a first round pick is irrelevant to the matter.

Yes,

but it could have possibly suspended Crabtree signing for however amount of days it was, and changed our season. The Bears still got Briggs and it really was a “no harm, no foul” kinda deal.
Granted nothing has been proven, but I would think the Crabtree situation is a bigger deal.

seeing as Crabtree signed for less than he wanted (and what the team’s supposed original offered) than I would write it off as “no harm, no foul”. Yeah, Crabtree held out, but ultimately signed.

I think the Jets are going to be penalized, and the Niners will receive nothing – that’s about the only difference I see in this outcome compared the Briggs situation. The Jets may be stripped of a 1st round pick, but the 49ers won’t be compenstated with one.

You make a good point. I guess it could be a “no harm, no foul” thing. He signed, but I still think it could have changed our season. Oh well. You’re probably right and we won’t get anything for it.

He signed for less? The 49ers didn’t sign Lance Briggs either, but they still were penalized. What about the fact that the Jets went out and go Braylon Edwrads and then the next day Crabtree was signed.

How does Braylon Edwards fit in? He wasn’t property of the 49ers, nor involved in this tampering case. The Jets needed a receiver and they got one, I don’t see how that makes the 49ers more likely to receive draft compensation.

I simply said I think the Jets will be the ones forfeiting a draft pick, and the 49ers won’t be compensated with that draft choice the Jets lose. Unless the league handles it the exact same way it did when the 49ers tampered with Briggs and the Jets and Niners have to flop picks in a round, while the Jets cough up an additional pick.

I think what he's saying is

Crabtree was holding out hopes of signing with the Jets in the next draft. Once the Jets got Braylon Edwards, that was no longer an option so he signed witht he 49ers.

The thing that makes it different is that Crabtree was a draft pick. It could turn out that the reason Crabtree was holding out was because of the tampering by the Jets. If they do not punish the Jets harshly and other teams start to do this then there really is no point for the draft if players just hold out a season and wait for the team that contacted them. If this is the case all the players coming out of college should just become free agents since they won’t always stay with the team that drafted them if they are promised more money. Like I said before I think the Jets will get punished with more but we won’t get that much especially since he signed.

But proving a tampering charge is hard. It almost becomes a he said she said. The Jets can always say they contacted Crabtree’s agent because he also represented a player on their team and they wanted to talk to him about that player. Either way, I doubt the 49ers will get much even if it is proven. After all, the 49ers were found guilty and all the Bears got was to move up 5 spots in the 3rd round.

Any penalty should be related to damages.

A basic tenant of civil law is that compensation is related to the damage suffered. If you sue someone but didn’t suffer any real, provable damages, you won’t receive much in the way of compensation. But if you have suffered demonstrable financial or other losses(reputation, trade secrets, etc.), then you stand to collect some serious compensation $$$.

Now let’s apply this to the Briggs and Crabtree situations. Chicago suffered very minimal damages with Briggs; he never missed a meeting, an OTA, a mini-camp, training camp, or even a preseason game, and eventually reached agreement with the Bears. Yet the 9ers lost a 5th round pick and a few draft positions in the 4th round. This seems to me like a fairly significant penalty for the amount of damage inflicted on Chicago, which I would characterized as minimal.

The 9ers suffered significant damages in the form of lost services from Crabtree – he wasn’t at meetings, missed OTAs, missed mini-camps, missed all of training camp, all preseason games, and the team lost his services for the first four games of the season. Pretty significant damages compared to those of the Bears, imho. So, if the Bears and 9ers are compensated in proportion to the damages they suffered, the 9ers should receive far more than the Bears did. How much more is anyone’s guess because this issue won’t be adjudicated in a courtroom but by Roger Goodell, who is not bound by legal precedent or any other normal judicial restriction. He can do pretty much whatever he likes from what I can tell. But if the 9ers’ compensation is proportional to what the Bears received, perhaps the Jets should lose a 2nd round pick and the 9ers should get to swap a 2nd round pick for the Jets’ 1st rounder. Or something like that.

But it would be prudent to keep in mind the principle of compensation awarded in proportion to damages suffered. Small damage, small compensation. Larger damages, larger compensation. But the damages must be demonstrable and provable and real – no mental anguish or emotional distress or things like that.

Alright, evidence is always tough to find in a tampering case but I’m not quite sure that is the case this time. Obviously something thing happened in the negotiation between Crabtree’s people and the Niners. The Niners have stated that they were close to a deal and then out of no where the dollar amount nearly doubled over night. There are 2 groups of people here who know the real story- the Jets and the Eugene Parker’s group. Of these two, Parker is the only one who might be forced to talk.

Why would Parker talk? Because the risk of the truth coming out is not worth the gamble. The Jets and Co. are one single team. If Parker goes into a room with Roger Goodell and attempts to spin this situation with half truths and King Goodell either knows more than Parker thinks he does or finds out that he lied later, Parker will lose his ability to do business with all NFL teams. Parker already made a major blunder in trusting Deon Sanders to do his PR work. Sanders, an NFL employee has already spilled the beans- not that dribble he spouted in a made for TV special- the goods. So Parker only has one option, to tell his side of the truth now and throw the Jets under the bus before the bus runs him over.

So let’s assume the truth is known. Let’s also assume that the Jets are guilty. In my opinion, this is a major infraction for the Jets. Before Crabtree signed, I would have expected a fine in line with the NFL draft value chart. The 10th pick is worth 1300 points. If the Jets were to pick around 23-25, those picks are valued at around 740 point (mid point of the three picks). In order for the 49ers to recoup the 1300 points, the Jets would owe and additional 2nd and 3rd rounder +. I would have expected a fine of this years 1st and 3rd and an additional 2nd rounder next year as punishment if Crabtree wouldn’t have sign and re-entered the draft. But he did sign. So where does this leave the Niners?

Crabtree signed but the damage was done. I expect, if the Jets are found guilty that the 49ers will receive the Jets 1st round pick this year and the NFL will receive a substantial fine- probably 7 figures spread between team, GM and officials. The Jets, if guilty, wronged another franchise and potentially all NFL teams by circumventing the draft. I fully expect Goodell to drop the hammer on the Jets if they are guilty.

I’m trying to remember the tampering case of the Seahawks vs the Packer or Vikings over the Offensive Lineman. Pretty vague lol. But, I remember someone got slapped pretty hard on that one.
