What happened to Joey Porter
So you all probably heard about the Joey Porter arrest for suspected DUI and assault of an officer. My friend who lives in Bakersfield was in the parking lot when the incident happened. He said that when Porter was pulled over he reached his arm out and grabbed the cops arm the pulled him into the side of the car. He then said "I'm m*****f****** Joey Porter." Now I don't know if the story is completely true but if the assault was that serious what do you think the future holds for Joey Porter? Could he be suspended for a year or possibly see jail time?

Not for that—probation most likely. The NFL doesn’t hand out suspensions until after the legal case is settled one way or the other, and it’s quite possible that this one won’t come to trial until after football season is done with.

Not true...
The NFL will suspend someone if legal actions haven’t moved forward. If he’s really being charged with assaulting an officer, I think he gets suspended immediately after details start coming out. Just what Goodell wants, NFL players now assault police officers instead of their wives or girlfriends. I say definite suspension if he touched the cop in any threatening manner.

California doesnt mess around with Drinking and Driving. He has no defense and only made things worse for himself when he slapped that cops hand.You better believe that cop will be in court. Goodell hasn’t been messing around with conduct lately and it will be no different for Porter. He’s likely to see some sort of suspension.
Also, the California courts are pretty quick about pushing things like this through, so I doubt he plays the entire season, if any at all, before the verdict is in.

Leonard Little had a previous track record of drunk driving—in fact he was involved in a fatal car crash due to his drunk driving when he was arrested a second time on DUI charges.
Porter hasn’t had any other run ins with the law and especially hasn’t been involved in a fatal car accident.

if he gets suspended for any amount of time that’s great for our bid as NFC West champions. Of course this was a dumb thing for Porter to do but why would a police officer ask to see the license of a black man sitting on 2002 Mercedes while he is pulling up to a fast food parking lot without any signs of driving under the influence. Then reach over and try to grab the car keys from the ignition… last time I checked the police did not have a warrant to search his car or try to obtain these keys without Porter’s consent. I am not a law student of any kind but a “peace” officer does not have the right to reach into someone’s car without permission.

He asked Porter to get out of the vehichle because he wreaked of alcohol (probable cause). Porter then tried to roll up his window and lock his door. The cop had every right to reach inside that window to unlock the door. Porter was resisting cooperation, and then when he stepped out of the car, he was resisting arrest. He got out of the car in a threatening manner according to reports. If all this surfaces as being true, he’s screwed.

according to the report, the officer was taking care of another driver and when he pulled up behind his friend they went over Porter’s car. To me it’s a little shady

I haven’t seen that in the articles I’ve read. I dont see anything shady about it, he was driving drunk… and he obviously did something to draw attention to himself, otherwise nothing would have came of it. He would’ve drove home and ate his taco bell.

probable cause
As Drew K mentioned, if as he says the vehicle smelled of alcohol, he has cause to make certain searches. I don’t have all the specifics in front of me, but I believe he can’t open the trunk, but is allowed to do a limited search of areas relatively within reach of Porter. Again, this is just some general information I am vaguely remembering from my Criminal Procedure class (2 years ago). I’ll find some more details for you.

I’m from Bakersfield and the guy has a split reputation as being a very generous philanthropist who has helped his community a lot but also a real jerk who causes trouble in his personal life. I went to the same high school as Porter but not at the same time. My sister did go to school with him and the consensus between her and her friends who are the same age as Porter is that he was a real jerk with a thuggish attitude even before he became famous. There have been a number of brawls at clubs here in Bakersfield that Porter is said to be associated with, and there is rumors that some of the club owners are considering banning him because of the trouble he brings.

If that's all true, the NFL will find that out in their individual investigation.
All of those factors will play a part in how much suspension he will get.

This isn’t something I made up… It was an account of a friend of mine who was in Bakersfield for Spring Break. My friend said he was about to be arrested for being drunk in public or something but the officer had to leave him to go help take care of Porter who was in the same parking lot.

I’m from bako (Bakersfield) and was watching the 5’oclock news, apparently Porter has hired a lawyer (Daniel Rodriguez). This lawyer is looking into the CHP that busted him. There have been many reports on this officer about being too aggressive during arrest. Very interesting..

That is the only reason they're dropping it...
Because of the cops history. Had it been another cop in the dept., he woulda been screwed. There was nothing wrong with the procedure, as Fooch mentions above.
Unless Porter talks about how it went down
we don’t know if the cop followed procedure or not.
He may have and his past record is getting him into trouble here, or he may not have. Who knows.
