<p>The Miami-Date State Attorney's released a memo closing out the investigation of <span>Colin Kaepernick</span>, <span>Quinton Patton</span>, and <span>Ricardo Lockette</span>. Charges were not filed, and this memo explains pretty much everything that went down in the investigation process. This should close everything out, with the players "exceptionally cleared" of any wrongdoing.</p>

<p>The Miami-Dade State Attorney's office announced on Thursday that they will not press any charges against <a class="sbn-auto-link" href="https://www.ninersnation.com/">San Francisco 49ers</a> quarterback <span>Colin Kaepernick</span>, wide receiver <span>Quinton Patton</span>, or <a class="sbn-auto-link" href="https://www.fieldgulls.com/">Seattle Seahawks</a> wide receiver <span>Ricardo Lockette</span>. A spokesperson for the State Attorney's office said <a href="http://www.csnbayarea.com/49ers/kaepernick-faces-no-charges-miami" target="_blank">there was no indication a crime was committed</a>:</p>

<p>No charges were ever filed, it was simply an investigation that resulted in no evidence of a crime. It's as simple as that.</p>
<p>This would appear to officially wrap up the "suspicious incident" that TMZ "reported" as being a potential sexual assault investigation. It did not take long for that to be proven to be an exaggeration on the part of TMZ. They doubled down on their reports, and given the mention of sexual assault by the spokesperson above, I'm sure TMZ will feel justified in what I view as defamatory content. I don't think there would be easy grounds for a lawsuit victory, but at least we know TMZ's full of crap. We saw them disregard the truth when <a href="http://www.ninersnation.com/2014/4/15/5618806/tmz-colin-kaepernick-photo-proof-lie" target="_blank">they published a photo</a> claiming it was Kap in LA shopping "seemingly without a care in the world." They later admitted it was not an accurate photo, but they defended themselves by throwing the photo provider under the bus.</p>
<p>Kap has proclaimed his innocence throughout, and as we've learned more and more about the incident, it has quickly moved into our rear view mirror. I think most people recognize what went down here. Some might throw out BS insults based on this event, but the upside to that is we can quickly recognize them for the trolls they are. For now, the rest of us can officially move on.</p>

<p>The Miami police department's special victims unit has informed the Sacramento Bee that <a href="http://www.sacbee.com/2014/06/02/6451146/kap-surplus-49ers-have-room-for.html" target="_blank">they are hoping to wrap up the investigation</a> into to "suspicious incident" by the end of the month. They are waiting for some scientific evidence and could not say for sure when exactly it would be finished. Keystone cops to the rescue!</p>
<p>Back in April, Mike Garafolo and Ian Rapoport both reported <span>Colin Kaepernick</span>'s contract negotiations were <a href="http://www.ninersnation.com/2014/4/18/5627616/colin-kaepernick-contract-negotiations-tabled-until-investigation-wraps" target="_blank">on hold while the police finished up their investigation</a>. Given that this investigation has dragged into June, it's not entirely shocking that things have been quiet on the negotiation front. Once it does wrap up, it would not surprise me if contract rumors started to percolate again.</p>
<p>We don't really know where the two sides stand in negotiations. We've heard numbers in the $18-$20 million or more range thrown around, but that could be to help push agendas in the discussion. There was talk the two sides started generally, and were moving into more specific proposals, but then the Miami nonsense became a thing. It seems likely to wrap up, but until then, we might just be stuck waiting to see what happens with contract negotiations.</p>
<p>Matt Maiocco is reporting <a href="http://www.csnbayarea.com/49ers/rogers-49ers-books-opens-room-kap-extension" target="_blank">the 49ers have $8.165 million in salary cap space</a>. While that is not an exorbitant amount, it is enough to potentially get a deal figured out with Kap. While a Kap extension creates some headaches for finding money for other players, I think most of us would much rather be in that situation than waiting for a deal to get done. If the 49ers are convinced Kap is there long-term option, they're going to have to pay the piper. I'd much rather it happen soon so the team can really move on to figuring out additional deals.</p>

<p>The Miami State Attorney is apparently waiting for one last piece of scientific evidence. And so we wait.</p> <p>Matt Barrows is reporting that <a href="http://www.sacbee.com/2014/05/30/6445624/miami-investigators-waiting-on.html" target="_blank">the Miami State Attorney</a> "an important piece of information to put the final nail into the investigation." The case was <a href="http://www.ninersnation.com/2014/5/28/5758210/miami-pd-presents-colin-kaepernick-quinton-patton-ricardo-lockette" target="_blank">turned over to them by the Miami PD</a> a couple days ago for determination on how to proceed. This did not close the investigation, but rather was just one more formality in the process of figuring this all out.</p>
<p>In reality, this is similar to the <span>Aldon Smith</span> LAX case in that the State Attorney (City Attorney in the case of Aldon Smith) is basically conducting the final part of the investigation. <a href="http://www.sacbee.com/2014/05/30/6445624/miami-investigators-waiting-on.html" target="_blank">According to the Miami spokesperson</a>, the final piece of evidence is scientific in nature. As Barrows points out, it could be the rape test that was allegedly taken, or it could be toxicology reports.</p>
<p>Hopefully this is one of the final articles we have to write before the Miami State Attorney announces that charges will not be filed against the three players. The whole case has been a bit odd given how nebulous so much of it seemed. It started with the initial report filed by the girl that led to the discussion of a "suspicious incident." The scummy folks at TMZ quickly labeled it the "<span>Colin Kaepernick</span> sexual assault investigation" and like one of those annoying little ankle-biter dogs (I prefer big dogs), TMZ has latched on and won't let go. Since then, we've heard reports that Kap was not at the apartment at this point, and then the 9-1-1 call did not exactly paint a good picture of the girl.</p>
<p>And now, we're getting closer to some kind of announcement to conclude the investigation. Hopefully we get that one final confirmation piece to end this thing and move on. Until then, I continue to say, <a href="http://www.ninersnation.com/2014/4/15/5618806/tmz-colin-kaepernick-photo-proof-lie" target="_blank">screw you TMZ</a>.</p>

<p>We have an update on the Colin Kaepernick, Quinton Patton, Ricardo Lockette investigation. The case has been turned over to the State Attorney's office.</p> <p>In case you had forgotten about it, the Miami police department investigation into a "suspicious incident" involving <span>Colin Kaepernick</span>, <span>Quinton Patton</span> and <span>Ricardo Lockette</span> has taken a step forward. Matt Maiocco is reporting the police informed CSN Bay Area <a href="http://www.csnbayarea.com/49ers/miami-police-concludes-suspicious-incident-investigation" target="_blank">they have completed their investigation of the incident</a>, and presented it to the Miami-Dade State Attorney's Office for consideration.</p>
<p>The next step is for the State Attorney's office to decide whether or not they will press charges against any parties involved. For comparison's sake, this is the same stage at which Aldon Smith's LAX investigation sits. The police in LA completed the investigation and now the City Attorney is deciding whether or not to press charges on a misdemeanor false report of a bomb threat. The Aldon Smith case was turned over to the City Attorney's office on April 24, which means over a month has passed without a resolution.</p>
<p>The police told Maiocco that the three players declined an invitation for an interview, but they would not reveal anything else. Given that the players were not pursued more aggressively, it's hard to think the State Attorney will be filing charges against any of the players. <a href="http://www.ninersnation.com/2014/5/6/5688220/ricardo-lockette-911-audio-colin-kaepernick" target="_blank">The 9-1-1 audio</a> seems to benefit the players. I'd say it benefits their story, but they've generally kept quiet on this whole thing. As more and more information comes out, it seems more and more likely that nothing came of the night.</p>
<p>A year ago, Michael Crabtree was <a href="http://www.ninersnation.com/2013/1/18/3893088/michael-crabtree-sexual-assault-investigation-news-updates" target="_blank">investigated for sexual assault</a> following the team's win over the Green Bay Packers. People were on edge initially about that, but in less than a week, <a href="http://www.ninersnation.com/2013/1/25/3917178/michael-crabtree-sexual-assault-investigation-no-charges-filed/in/3657129" target="_blank">the DA's office announced</a> they would not file charges. It seemed like a fairly simple investigation and it was cleared up quickly. This has taken a good deal longer, and there's been no real explanation why it has taken so long. At some point though, the State Attorney will make some kind of announcement, hopefully ending this whole thing and putting it completely in the rear view mirror.</p>

As more information has come to light, it has become clear TMZ is in the wrong in continuing to refer to this as Colin Kaepernick being investigated for sexual assault.</p>
<p>It's not surprising that TMZ has less interest in the truth, and more interest in page views. I'm a fan of page views here at Niners Nation, but I like to think I get things accurate, or at least educatedly accurate. I used "sexual assault" in the initial title, but fairly quickly changed it to reflect the "suspicious incident" phrasing.</p>
<p>TMZ on the other hand continues to push this strictly for page views. <span>Ricardo Lockette</span> never referred to Colin Kaepernick by name, but TMZ refers to it as the "Colin Kaepernick 911 calls". Even worse, they have generally ignored some of the recent information that has come out in favor of Kap. And of course, we showed you <a href="http://www.ninersnation.com/2014/4/15/5618806/tmz-colin-kaepernick-photo-proof-lie" target="_blank">their blatant disregard for the truth with their use of Kap pictures</a>. They admitted the picture was wrong, but they threw the photo agency under the bus. Yet another example of their cowardly approach to business. </p>
<p>The worst part might be the fact that they continue to point to their initial report that Kap was named a suspect in a sexual assault investigation. He was listed as a suspect, but that was strictly a paperwork issue, and it was for a suspicious incident. They are basing their information on their assortment of cowardly sources.</p>
<p>I don't think Kap would have an easy case if he tried to sue TMZ, but I still wouldn't mind seeing him bring a suit. It likely won't change what TMZ does, but maybe he finds the right court and gets lucky. I'm not holding my breath, but I would still love to see it.</p>

<p>Some audio has reportedly emerged of Ricardo Lockette's 9-1-1 call the night of the Miami "suspicious incident". We take a look at what it means.</p> <p>The Miami police have been fairly quiet about the <span>Ricardo Lockette</span>, <span>Colin Kaepernick</span>, <span>Quinton Patton</span> "investigation", but as happened last month, we're seeing more and more leaks from the investigation. The latest is <a target="_blank" href="http://www.miamiherald.com/2014/05/06/4101367/police-focus-on-911-calls-from.html">two 9-1-1 calls made that night</a>. One of the calls purported to be a security guard, and the second purported to be Ricardo Lockette. You can listen to the audio <b><a href="http://tmz.vo.llnwd.net/o28/newsdesk/tmz_audio/colin%20911_v2.mp3" target="_blank">HERE</a></b>.</p>
<p>The single audio contains both calls, with the security guard's call first, and Lockette's second. The Lockette call starts at about 1:35. Lockette tells the cops there is a young lady in his friend's bed, she has undressed and she will not leave. Lockette says they told her his friend would not be there that night, but she refused to leave until she saw him. He never identifies Colin Kaepernick in the audio, but reports since the night in question have indicated Kap is the friend identified as not being there. Lockette also says that the man she is looking for is not her boyfriend, but rather someone she wants to sleep with.</p>
<p>The situation is still being clarified. Team Kaepernick has been relatively quiet on the situation as they let the investigation finish up. <a href="http://www.ninersnation.com/2014/4/11/5604540/colin-kaepernick-tweets-out-statement" target="_blank">Kap tweeted</a> about it shortly after the news came out, and <a href="http://www.ninersnation.com/2014/5/2/5676240/colin-kaepernick-miami-suspicious-incident-comments-turlock-prayer-breakfast" target="_blank">made a very general reference to it</a> during a prayer breakfast last week. I imagine we'll get a more formal statement at some point, but if they know exactly the kind of stuff that will come out from the investigation, it will seemingly clear Kap with relative ease. For now, hopefully this ends with the authorities indicating no charges will be filed against the players, and that will be that.</p>
